Draft for review by an attorney before Lives Touched takes payment from the public. Words in [brackets] need filling in.
Terms of use
Lives Touched ("we") is run by [Lives Touched LLC, address]. By creating or contributing to a memorial, you agree to these terms.
Your family owns what you share
Photos, videos, voice recordings, words and everything else you or your guests add stay yours. You give us only the permission we need to keep them safe and show them to the people you choose: to store them, make copies at different sizes, convert them so they play on every device, and include them in the memorial's pages, slideshows, books and films that you ask for. We never sell your content, never use it in advertising, and never use it to train artificial intelligence. Anyone who adds something promises they have the right to share it.
Plans and payment
- Guestbook: free, with no time limit.
- Full memorial: $100 once, fully open for 3 years, including up to 3000 visits to the photorealistic globe. Anyone in the family can keep it fully open for another 3 years for $25.
- Printed books, films and other extras are priced when you order them.
- Payments are taken by Stripe. We never see or store your card number. [Refund policy, e.g. a full refund within 14 days if you ask.]
Nothing is deleted when a plan ends
If a full memorial's term ends and nobody renews it, it becomes preserved: every photo, voice, video and memory stays, and the guestbook stays open. Only the features that cost money to run each day pause (the photorealistic globe, live audio and new films) until anyone in the family reopens it for $35. We do not delete a memorial for non-payment.
Who looks after a memorial
Each memorial has one person who looks after it (the owner). Control only ever changes hands with the owner's say-so: the owner hands it over, or approves someone's request, or names people in advance as next in line. Someone named in advance can take over after they confirm their email and a notice period of 7 days passes, during which the owner and everyone else named can stop it with one tap. Nobody else can take over a memorial, including Lives Touched staff, and paying for a memorial gives no access to it. If no one the owner chose can carry on, the memorial stays safe and unchanged.
Being kind
Please don't share anything unlawful, hateful, or private about someone else, or anything that isn't yours to share. The owner and the family can remove anything from their memorial. Anyone can report something to us at [email], and we may remove content or accounts that break these terms.
If Lives Touched ever closes
We will give every owner at least 90 days' notice and a way to download everything in their memorial.
Paid links
Some florist links may be paid links, which means Lives Touched may earn a small commission if you order through them. They are always labeled "Paid link". We never take a share of donations to charities or memorial funds.
The rest
[Limits of liability, governing law, how we tell you about changes, and contact details, to be completed with an attorney.]
